Malaysia Investor Pass & ESD Employment Pass 2026 Complete Guide for Foreign Investors & Company Owners

Malaysia now has a specific Investor Pass for prospective investors, while foreign company owners who intend to actively work in their Malaysian business generally need to assess a different pathway, such as the Employment Pass.

These two routes should not be confused. Your correct pathway depends on whether you are still evaluating an investment, already own the Malaysian company, or intend to work for that company.

Malaysia’s Investor Pass Is Not the Same as an Employment Pass

The Investor Pass is designed primarily for foreign business visitors and potential investors who are exploring or progressing an investment into Malaysia.

If you already own a Malaysian company or hold a Malaysian company directorship, the current Investor Pass policy excludes you from that category. A different immigration route should be assessed.

What Is Malaysia’s Investor Pass?

Malaysia’s Investor Pass is a multiple-entry visa facility intended to facilitate business visits and investment-related activity for qualifying foreign investors.

The current framework permits an approved Investor Pass holder to enter Malaysia for six months, with the possibility of an additional six months subject to justification and approval.

The current Investor Pass facility applies to Peninsular Malaysia and the Federal Territory of Labuan, and does not apply to Sabah or Sarawak.

Already Own a Malaysian Company? Investor Pass Is Not Your Route

From 13 March 2026, the “Existing Investor” category was removed from the Investor Pass framework.

Current ESD policy states that a person who already owns a Malaysian company or holds a directorship in a Malaysian company is not eligible for the Investor Pass.

The Expatriate Services Division is the first point of contact for companies that wish to employ eligible expatriates under the ESD framework.

The company generally needs to establish its eligibility and complete ESD company registration before proceeding with the relevant expatriate Employment Pass application.

The RM500,000 figure relates to ESD company registration for a 100% foreign-owned company. Ordinary incorporation and sector licensing are separate questions.

Malaysia’s Revised Employment Pass Categories

Malaysia implemented new Employment Pass salary thresholds from 1 June 2026 together with a revised employment-duration framework.

Salary alone does not create eligibility.

Company eligibility, the role, sector, documents, approving agency and prevailing expatriate requirements must all be considered.

Can Family Members Join the Investor?

INVESTOR PASS No Dependant Pass

Current ESD Investor Pass FAQs state that Investor Pass applicants cannot bring dependants under a Dependant Pass through that facility.

EMPLOYMENT PASS Separate Family Pass Assessment

Qualifying Employment Pass holders may have family-related pass options subject to the applicable rules and category.

Do not market the Investor Pass as a family relocation visa.

What are the Employment Pass salary requirements in 2026?

For applications from 1 June 2026, Category I starts at RM20,000 monthly, Category II covers RM10,000–RM19,999 and Category III covers RM5,000–RM9,999, subject to all other requirements.

Is Employment Pass approval guaranteed if I invest RM500,000?

No. Paid-up capital is only one company-level requirement. The individual application remains subject to the applicable immigration, position, salary, sector and supporting-document requirements.
